Terms of Service
The terms for using EverPray.
These Terms of Service (“Terms”) are an agreement between you and QuaintInc LLC (“QuaintInc,” “we,” “us”), the maker of the EverPray app and website (together, “EverPray”). By creating an account or using EverPray, you agree to these Terms and to our Privacy Policy. If you don’t agree, please don’t use EverPray.
1. Who can use EverPray
You must be at least 13 years old to use EverPray. If you’re under 18, or under the age of majority where you live, you may use EverPray only with the permission of a parent or guardian, who agrees to these Terms for you.
2. Your account
You’re responsible for keeping your sign-in details secure and for activity on your account. Please give accurate information and tell us at support@everprayapp.com if you think someone has accessed your account without permission. You can delete your account at any time in Settings → Account.
3. Subscriptions and free trial
- Plans. EverPray offers paid subscriptions, currently Monthly and Yearly. Prices are shown in the app before you buy, and may vary by country and include applicable taxes.
- Free trial. New subscribers may get a 7-day free trial. Unless you cancel at least 24 hours before the trial ends, your subscription starts automatically and you’re charged the plan price. Each person may use the free trial only once.
- Automatic renewal. Subscriptions renew automatically for the same period at the then-current price, unless you cancel at least 24 hours before the end of the current period. Your App Store or Google Play account is charged within 24 hours before renewal.
- Cancelling. You can cancel any time in your Apple ID subscription settings (Settings → [your name] → Subscriptions) or in Google Play. You keep access until the end of the period you’ve paid for.
- Payments and refunds. Purchases are processed by Apple or Google under their terms. Refund requests are handled by them; for Apple, go to reportaproblem.apple.com.
- Price changes. If a subscription price changes, you’ll be notified in advance as the App Store or Google Play requires, and you can cancel before the new price applies.
4. AI-written prayers
EverPray uses artificial intelligence to write prayers from what you share in your check-in. Please keep in mind:
- Prayers are generated for personal devotional use. They are not pastoral counsel, spiritual direction or theological teaching, and they don’t represent the views of any church or denomination.
- AI can make mistakes. Generated text, including scripture references, may occasionally be inaccurate or not what you intended. Please read prayers thoughtfully and use your own judgment.
- EverPray is not medical, mental-health, legal or financial advice, and is not an emergency service. If you are in crisis or thinking about harming yourself, call or text 988 (the Suicide & Crisis Lifeline in the US) or your local emergency number right away.
5. Your content
Your check-ins, prayers, Prayer Log entries and notes (“Your Content”) belong to you. You give QuaintInc a limited, non-exclusive, worldwide, royalty-free license to store, process and display Your Content only as needed to provide EverPray to you, as described in our Privacy Policy. This license ends when you delete Your Content or your account, except for copies we must keep by law. As between you and us, prayers EverPray writes for you are yours to keep, use and share.
6. Acceptable use
Please don’t:
- use EverPray for anything illegal, harmful, harassing or hateful;
- try to access other people’s accounts or data, or interfere with EverPray’s security or operation;
- copy, reverse-engineer, resell or build a competing product from EverPray, except where the law allows it; or
- use automated means to generate prayers in bulk, or try to misuse the AI features.
7. Our content and trademarks
EverPray, including its design, illustrations, text and logo, belongs to QuaintInc and is protected by law. Subject to these Terms, we give you a personal, non-transferable, revocable license to use the EverPray app on devices you own or control, for your own non-commercial use. Scripture quotations are from the World English Bible (WEB), a public-domain Bible translation.
8. Third-party services
EverPray relies on third-party services, including Apple, Google, OpenAI and Supabase. Your use of their services may also be subject to their terms, and we aren’t responsible for them.
9. Changes and ending your use
We may update EverPray and these Terms. If a change is material, we’ll let you know in the app before it takes effect; continuing to use EverPray afterwards means you accept the updated Terms. You may stop using EverPray at any time. We may suspend or end access for anyone who seriously or repeatedly breaks these Terms, and will give notice when we reasonably can.
10. Disclaimers
EverPray is provided “as is” and “as available.” To the fullest extent the law allows, QuaintInc disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don’t promise that EverPray will be uninterrupted or error-free, or that generated content will be accurate or suitable for any particular purpose.
11. Limitation of liability
To the fullest extent the law allows, QuaintInc will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of EverPray. Our total liability for any claim relating to EverPray is limited to the greater of the amount you paid us for EverPray in the 12 months before the claim, or US $50. Some places don’t allow these limits, so they may not fully apply to you.
12. Indemnity
If you use EverPray in a way that breaks these Terms or the law, and that leads to a claim against QuaintInc, you agree to cover the reasonable costs of that claim, to the extent the law allows.
13. Governing law
These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Texas, and you and QuaintInc consent to their jurisdiction. This does not take away any protections you have under the consumer laws of the place where you live.
14. Apple App Store terms
If you downloaded EverPray from Apple’s App Store:
- These Terms are between you and QuaintInc, not Apple. QuaintInc, not Apple, is solely responsible for EverPray and its content.
- Your license to use EverPray is limited to Apple-branded devices you own or control, as allowed by the Usage Rules in Apple’s Media Services Terms.
- Apple has no obligation to provide maintenance or support for EverPray.
- If EverPray fails to meet any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any). To the fullest extent the law allows, Apple has no other warranty obligation for EverPray.
- QuaintInc, not Apple, is responsible for any product claims relating to EverPray, including product liability, legal or regulatory compliance, and consumer protection claims.
- If a third party claims that EverPray infringes their intellectual property, QuaintInc, not Apple, is responsible for investigating and handling the claim.
- You confirm that you are not located in a country subject to a US Government embargo, and that you are not on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
15. General
If any part of these Terms can’t be enforced, the rest remains in effect. If we don’t enforce a right right away, we haven’t given it up. You may not transfer these Terms without our consent; we may transfer them as part of a merger or sale of our business. These Terms and the Privacy Policy are the entire agreement between you and us about EverPray.
